2.1 Binding Agreement
By creating an account, accessing our website, or using our Services, you:
- Confirm you have read and understood these Terms
- Agree to be legally bound by these Terms
- Represent that you are at least 18 years old (or 13 with parental consent)
- Have the legal capacity to enter into this agreement
2.2 Changes to Terms
- We'll notify you via email 30 days before changes take effect
- We'll post updated Terms on our website with a new Effective Date
- Continued use after changes take effect constitutes acceptance
- If you disagree with changes, cancel your account before effective date
3. Eligibility and Account Registration
3.1 Age Requirements
- 18+ years old: Full access to all Services
- 13–17 years old: Parental consent required
- Under 13: Not permitted to use Services
3.2 Account Creation
- Provide accurate information (name, email, payment details)
- Maintain account security (strong password, enable MFA when available)
- Not share your login credentials
- Notify us immediately of unauthorized access: support@enduraservice.co.za
3.3 Account Types
Individual Accounts (DRAFT)
- For personal use by students, freelancers, individuals
- One person per account (no account sharing)
- Can upgrade to Team account for collaboration
Business Accounts (BLVNK)
- For accounting firms, SMEs, organizations
- Multiple users under one organization
- Admin controls user access and permissions

Free: Basic dashboard only

5. Subscription and Payments
5.1 Pricing
- Current pricing available at endura.ai/pricing
- 30 days' notice for price changes to existing subscribers
- Existing subscribers grandfathered for 6 months
5.2 Payment Methods
- Credit/debit cards: Visa, Mastercard (via Paystack)
- Bank transfers (EFT): Annual plans only (R20K+ invoices)
- Mobile money: MTN Money, Vodacom Vodapay (coming Q2 2026)
5.3 Taxes
- SA customers: 15% VAT added at checkout
- International customers: May be subject to local taxes
- VAT invoices available in Settings → Billing → Invoices
5.4 Failed Payments
6. Acceptable Use Policy
6.1 Permitted Uses
- Create and manage study materials (DRAFT)
- Process invoices and accounting data (BLVNK)
- Collaborate with team members
- Integrate with third-party tools (Google Calendar, Xero, etc.)
6.2 Prohibited Uses
Illegal Activities
- Violate any laws or regulations
- Engage in fraud or identity theft
- Share pirated or copyrighted materials
- Facilitate money laundering
Abuse
- Upload malware, viruses, or malicious code
- Attempt to hack or breach security
- Use Services to spam
- Scrape data without written permission
Harmful Content
- Upload defamatory, obscene, or hateful content
- Share explicit sexual content
- Promote violence or self-harm
Commercial Misuse
- Resell access without authorization
- Use our AI to train competing AI models
- Mass-create accounts for commercial purposes
6.3 Enforcement
7. Intellectual Property Rights
Endura Owns
- DRAFT and BLVNK software (code, algorithms, UI/UX)
- Endura trademarks, logos, and branding
- AI models and training data
- Documentation and help content
You Own
- Notes, tasks, quizzes you create (DRAFT)
- Invoices, financial data you upload (BLVNK)
- Any other content you create or upload
We process your content to provide Services. We never sell your content to third parties.
8. Data Privacy and Security
Security Measures
- AES-256 encryption at rest
- TLS 1.3 encryption in transit
- Row-level security (database isolation)
- Regular security audits
Data Retention
- Active accounts: Data retained indefinitely
- Deleted accounts: 30-day grace period, then permanent deletion
- Financial records: Retained 5 years (SARS requirement)
- Audit logs: Retained 2 years (security compliance)
9. Disclaimers and Limitations of Liability
OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
We do NOT guarantee error-free operation, AI accuracy, specific results, or compatibility with all devices.
9.4 Limitation of Liability
To the maximum extent permitted by law, our liability is capped at the amount you paid us in the past 12 months.
Exceptions (we ARE liable for):
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Violations of POPIA (data privacy rights)
10. Dispute Resolution
10.1 Governing Law
These Terms are governed by the laws of South Africa.
10.2 Informal Resolution (First Step)
- Email support@enduraservice.co.za with your complaint
- We'll respond within 10 business days
- We'll try to resolve amicably (phone call, negotiation)
Most disputes are resolved at this stage.
10.3 Arbitration
- Binding arbitration (not court) if informal resolution fails
- Location: Pretoria, South Africa
- Arbitrator: Appointed by AFSA
- Costs: Split 50/50 (unless arbitrator decides otherwise)
10.5 Small Claims Court Exception
For amounts <R25,000, you may file in small claims court (Pretoria Magistrates' Court or your local court).
11. Miscellaneous
11.1 Entire Agreement
These Terms (plus Privacy Policy, Refund Policy, Security Policy) constitute the entire agreement between you and Endura.
11.2 Severability
If any provision is found invalid, that provision is severed and the rest of the Terms remain in full effect.
11.3 Waiver
Our failure to enforce a right doesn't waive that right. We can still enforce it later.
11.4 Assignment
You may not transfer your account without our consent. We may assign these Terms if Endura is acquired (we'll notify you).
11.5 Force Majeure
We're not liable for failures caused by events beyond our control: natural disasters, war, government actions, internet infrastructure failures, or pandemics.
11.8 Language
If these Terms are translated, the English version controls in case of conflict.
